1. Agreement to Terms

By accessing or using Outgrow (outgrow.so), operated by ROGA AI LIMITED ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

2. Description of Service

Outgrow is an AI-powered platform that helps businesses manage their Google Business Profile. Features include:

• AI-generated posts and content for Google Business Profile
• Review monitoring and AI-powered response suggestions
• Performance analytics and insights
• Profile health scoring and optimization recommendations

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Google Account Connection

By connecting your Google Business Profile, you:

• Authorize us to access your Google Business Profile data as described in our Privacy Policy
• Confirm you have authority to manage the connected business profiles
• Understand you can revoke access at any time through Google Account settings
• Agree that we are not responsible for changes to Google's APIs or policies

5. Subscription and Payments

5.1 Free Plan

We offer a free tier with limited features.

5.2 Paid Plans

• Pro Plan: $19/month (billed monthly)
• Lifetime Plan: $79 one-time payment

5.3 Billing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (for monthly plans) until you cancel.

5.4 Refunds

Monthly subscriptions may be cancelled at any time; no refunds for partial months. Lifetime plans include a 14-day money-back guarantee.

6. Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Use the service for spam, phishing, or fraudulent activities
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated scripts without permission
• Resell or redistribute the service without authorization
• Post false, misleading, or defamatory content

7. AI-Generated Content

Our service uses artificial intelligence to generate content suggestions. You understand that:

• AI-generated content is provided as suggestions only
• You are responsible for reviewing and approving all content before publishing
• We do not guarantee the accuracy, appropriateness, or effectiveness of AI suggestions
• You retain full responsibility for content published to your Google Business Profile

8. Intellectual Property

The service, including its design, features, and content (excluding user content), is owned by ROGA AI LIMITED and protected by intellectual property laws. You receive a limited, non-exclusive license to use the service for its intended purpose.

Content you create or publish through our service remains your property. By using our service, you grant us a license to store, display, and process your content as needed to provide the service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The service will be uninterrupted or error-free
• Results from using the service will be accurate or reliable
• The service will meet your specific requirements
• Google will maintain compatibility with our service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROGA AI LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ROGA AI LIMITED and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these terms or is harmful to other users or the service.

Upon termination, your right to use the service will cease immediately. Provisions that by their nature should survive termination will survive.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of Gibraltar, without regard to its conflict of law provisions.
